General terms and conditions (GTC) for orders in the online shop of fishbelly lingerie

4. Terms of delivery , prices, shipping costs
The indicated prices include the statutory sales tax and other price components. In addition, there are explicitly stated shipping costs, which are to be borne by you. These are calculated depending on the weight, shipping destination and shipping company. Shipping costs are added to the stated product prices. You also bear other costs incurred by shipping the goods, in particular customs duties or taxes for orders outside the EU. Our current prices at the time of the respective contract conclusion apply.
The handover of the ordered items to the selected shipping company takes place within 3 working days for orders within the EU. The period begins to run on the day after receipt of payment. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the following working day. The standard shipping time of the selected shipping company is then between 2-4 working days (Monday-Saturday).
If items have been ordered with different delivery times, we will ship the goods in one shipment, unless we have made any other agreements with you. In this case, the delivery time is determined by the item with the longest delivery time that was ordered.
Unless otherwise agreed, delivery will be made from our warehouse to the delivery address you specified. You must bear any additional delivery costs for additional expenses that arise because you or a person authorized by you and willing to accept the delivery cannot be found at the delivery address given at the time of delivery.

In order to be able to pay the invoice amount via Sofort, you must have a bank account activated for online banking, identify yourself accordingly and confirm the payment order to us. Any applicable transfer, payment and/or transaction fees are to be borne by you, unless otherwise stated.
If you are in arrears with your payment, we are entitled to demand interest on arrears at a rate of 5 percentage points above the base interest rate announced by the European Central Bank per year. If we can prove greater damage (e.g. due to returned direct debits), we can demand compensation for this greater damage instead of default interest. However, you are at liberty to prove that no damage or only a small amount of damage has occurred.
6. Retention of Title
We reserve ownership of the goods until the purchase price has been paid in full.

8 . Warranties and Guarantees

If, in the case of legitimate defects, we meet our obligations to provide a replacement delivery, you are obliged to return the defective goods that were delivered first at our expense but at your own risk within fourteen days of receipt of the replacement delivery. In order to avoid losing the item to be returned, we may ask you in such a case to commission a shipping company with the return shipment that has a so-called tracking system that can be used to track the whereabouts of the shipment.
We are only liable for our own fault and only for intent and gross negligence, regardless of the legal basis.
